Terms and Conditions at Predator Software
Quotes and estimates from Predator Software, are issued with the following terms and conditions to protect both parties and clarify project scope.
- Travel expenses, including mileage at the current IRS standard rate, will be billed to the customer at cost, upon completion of the onsite services, or at the end of each completed phase, and may or may not be quoted.
- Purchased Software licenses are issued via USB SIM and will be temporary at the time of shipment, with permanent codes delivered after payment in full. Purchased Software licensed via network card will receive extended temporary codes (until the end of the Premier Support period) after payment in full.
- Subscription Software, and any renewals thereof, is licensed via network card and will receive temporary codes according to the terms of the subscription agreement.
- Budgetary quotes are made on a best effort basis as a pricing guideline and is not considered a final quote. Predator reserves the right to reject POs based on budgetary quotes when prices have changed. Hardware availability and price increases occur regularly with electronics. Predator reserves the right to suggest alternatives or re-quote prices due to supply chain issues or tariff price increases.
- Predator Premier Support includes software maintenance, updates, phone and web-based support. Refer to www.predator-software.com/predator_support.htm for details.
- If Predator includes third-party software on this quote as part of customer’s solution, additional third-party registration, EULA, licensing and terms may apply.
- Predator services require a scope of work or implementation plan which must be signed by customer’s project lead.
- Best effort will be made to complete the scope of work as quoted. Should additional time or materials be required, customer authorizes up to $3,000 USD to be invoiced against the original Purchase Order without requiring a Change Order.
- Some Predator application functionality relies on specific equipment options. Some equipment may not be supported or support all Predator application features.
- Predator Remote Express installations and hourly services are not Predator Implementations; they are pre-paid technical services designed to back-up knowledgeable customers in their efforts to complete a self-service project.
- Predator Hardware includes a 5-year warranty. Refer to www.predator-software.com/predator_hardware_warranty.htm for details.
- Any sales or VAT taxes Predator is required to collect and remit will be added to the invoice. Any claimed sales or VAT tax exemption or Reseller Permit must be provided by the customer.
- Deposit payments must be received by Predator prior to Predator shipping hardware or scheduling onsite services.
- Predator will prepay and add any required shipping charges and ship via UPS Ground unless specified differently in the Final Quote or customer’s Purchase Order. Predator can bill shipping to customer’s UPS or FedEx account number if provided by customer prior to shipping.
- Failure to provide, and have ready at the time of services, installed/strung cables, necessary power outlets, network details, network drops, required machine options, required hardware, valid electrical signals, required sensors, required servers, databases, PCs, networking equipment or networking cabling, sufficient wireless strength and coverage, network switch ports, static IP addresses, IT personnel, machine access, faulty machine tools, faulty CNC controls, missing CNC options, faulty RS232 or Ethernet ports and cables, unavailability of documentation will cause troubleshooting of machine tools, CNC controls and their options will cause delays, potential change orders, additional billable services and extra travel expenses.
